The invention provides a crop seed non-expression promoter SAFES5 and application thereof and further provides an expression box comprising the promoter and a crop expression carrier.Specifically, the promoter is applied to crop gene engineering.The promoter can specifically drive exogenous genes to be expressed in green crop leaf tissue or other non-seed tissue.Therefore, if the promoter is utilized for transforming crops, expression positions of insect resisting genes and other important genes can be limited, the utilization efficiency of the exogenous genes can be improved, meanwhile, expression and accumulation of heterogeneous toxalbumin on edible parts are avoided, the probability of allergies is lowered, and worries of the society and the public are reduced.
